Consumer's right to withdraw from the Contract (return of Goods)

The Consumer may withdraw from the Agreement for the sale of Goods concluded remotely without giving any reason, by making a statement to that effect, within 30 (thirty) days, whereby the time limit shall run from taking possession of the item by the Consumer or a third party indicated by the Consumer (other than the carrier), and in the case of a contract that involves multiple items that are delivered separately, in parts or in parts - from taking possession of the last item, part or lot. In order to meet the deadline it is sufficient to send an appropriate statement before its expiry to the address of the online shop, or by e-mail to: sklep@hurom.com.pl

The statement referred to in paragraph 1 above may also be submitted on the form, the specimen of which is attached as Annex No. 2 to the Act and Annex No. 1 to the Regulations

In the case of withdrawal from the Agreement for Sale of Goods concluded at a distance, the agreement shall be considered as not concluded.

If the Consumer has made a statement of withdrawal from the Sales Agreement before the Seller accepted his offer, the offer shall cease to be binding.

Consumer's obligations

The Consumer shall be obliged to return the Goods to the Seller or transfer them to a person authorised by the Seller to collect them promptly, but no later than 14 days from the date of withdrawal from the Sales Agreement, unless the Seller has offered to collect the Goods himself. In order to meet the deadline it is sufficient to send back the Goods before its expiry. The Goods shall be packed in a manner which guarantees their safe transport.

The Consumer shall bear the direct costs of returning the Goods (return cost).

The Consumer shall be liable for any diminution in the value of the Goods resulting from the use of the Goods beyond what is necessary to ascertain their nature, characteristics and functioning.

Seller's obligations

The Seller shall be obliged immediately, no later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the Sales Agreement, to return to the Consumer all payments made by him, including the costs of delivery of the Goods, whereby if the Seller has not offered to collect the Goods from the Consumer himself, he may withhold the reimbursement of payments received from the Consumer until receipt of the item back or delivery by the Consumer of a proof of its return, depending on which event occurs first.

The Seller shall return the Goods to the Consumer immediately, no later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the Sales Agreement.

The Seller shall refund the payment using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to a different method of refund that does not involve any costs to the Consumer.

If the Consumer has chosen a method of delivery of the Goods other than the cheapest ordinary method of delivery offered by the Seller, the Seller shall not be obliged to reimburse the Consumer for any additional costs incurred by the Consumer.

We suggest enclosing proof of purchase to facilitate the return process.

Statutory exclusion of the right of withdrawal from the Contract of Sale

The right of withdrawal shall not apply in situations specified in Article 38 of the Act, i.e. in relation to agreements:

  • provision of services where the entrepreneur has performed the service in full with the express consent of the consumer who has been informed prior to the performance of the service that after the fulfilment of the service by the entrepreneur, he will lose the right to withdraw from the contract;
  • where
  • where the price or remuneration is dependent on fluctuations in the financial market which are not controlled by the trader and which might occur before the end of the withdrawal period;
  • where the object of the performance is a non-reproduced item, produced to the consumer's specifications or intended to meet the consumer's individual needs;
  • in which the object of performance is an item supplied in a sealed package which cannot be returned after opening the package for health protection or hygienic reasons, if the package has been opened after delivery;
  • in which the subject of the performance are things which after delivery, due to their nature, become inseparably connected with other things;
  • where the object of the performance is alcoholic beverages, the price of which has been agreed upon at the conclusion of the sales contract, the delivery of which can only take place after 30 days and the value of which depends on fluctuations in the market which cannot be controlled by the trader;
  • where the consumer has explicitly requested the trader to come to him for the purpose of carrying out urgent repairs or maintenance; if the trader provides services in addition to those which the consumer has requested or supplies items other than replacement parts necessarily used in carrying out repairs or maintenance, the consumer shall have a right of withdrawal in respect of those additional services or items;
  • where the supply of services consists of sound or visual recordings or computer software supplied in a sealed package if the package is opened after delivery;
  • contracts for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts;
  • contracts for the supply of newspapers, periodicals or magazines
  • contracted by public auction;
  • provision of accommodation other than for residential purpose, carriage of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract provides for a specific date or period of performance;
  • the supply of digital content which is not recorded on a tangible medium where performance has begun with the consumer's express consent before the end of the withdrawal period and after the trader has informed the consumer of the loss of the right to withdraw from the contract;
